The parties agree that there are no material issues of fact. (1) whether there are any genuine issues of material fact and (2) whether the lower courts erred in their application of the law. On appeals from summary judgments, this court must consider two questions: The developers of the planned development district and two companies with stores within the development intervened as defendants and are also respondents on appeal. The district court granted Eagan's motion for summary judgment, ruling that the building did not violate Eagan's zoning code height restrictions because it was authorized by Eagan's approval of a planned development district. Appellants Brent and Lauren Florine, residents of respondent City of Eagan, asked the district court to declare unlawful the construction of a medical office building, both three stories high and located less than 300 feet from a single-family residential district. Appellants seek reversal of a summary judgment ruling that a three-story building does not violate city code height restrictions because it was authorized by council approval of a planned development district.
